EDITORIAL POSTAL CRUSADER FEBRUARY-2013


WE ARE NOT GOING TO SURRENDER.
JOIN THE TWO DAYS STRIKE ON FEBRUARY 20 & 21
               We, the Postal employees, have a proud and inspiring history of participating in the freedom struggle of our country against the British imperialism and in the post-independent India against the onslaughts of the retrograde policies of the Government of India.  Many of our leaders and comrades have sacrificed their life for the cause of the coming generation.  Job security, wages, pension and other service benefits are all the outcome of the struggle and sacrifice of hundreds and thousands of such comrades.  They faced dismissal, removal, suspension, increment cut, transfer to remote places, break-in-service and other severe victimisations.  Dies-non was not at all a punishment for them.  They never complained about wage-cut due to dies-non.  Not even  a single benefit was given by the Government without struggle and consequent heavy victimisations.  1st to 6th Pay Commissions were appointed by the Government only after the united struggle of the employees, each time.
               Now we are facing a very crucial and critical situation.  The ill-effects of the neo-liberal economic policies of the Central Government has become the greatest threat to the survival of the entire working class, especially Central Government employees including five and a half lakhs Postal, R M S and Gramin Dak Sevaks.  The question before us is -Are we able to protect our job security and hard-earned benefits?  Are we ready to fight or are we going to surrender before this attack?  The answer is - No. We are not going to surrender.  We will continue our fight till the imperialist globalisation policies are thrown to winds, just as we have thrown the British imperialism out of our country.   We are not alone, crores and crores of workers and employees are with us in this fight.  We are ready for sacrifice.   We are not going to run away from  our responsibilities.  We shall face the challenge and continue our fight to change the system in our favour.  Ultimate victory will be ours.
               It is this uncompromising spirit and the readiness for sacrifice, that made National Federation of Postal Employees (NFPE) to join the two-days historic strike of the working class on 2013 February 20, 21.  The strike is being organised by the entire trade unions including INTUC, BMS and the left trade unions.  In the Postal, the strike is organised by Central JCA, including NFPE and the INTUC affiliated FNPO.  This is the first time in the history of India a cent per cent united strike of 48 hours by all the Unions and Federtions is taking place.  More than ten crores workers will participate in the strike.  The working class of India, in one voice, demand the UPA Government to change the imperialist globalisation policies.
               Central Government employees are the first victims of the neo-liberal economic policies pursued by the Central Government from 1991 onwards.  During the last twenty years about eight lakhs posts are abolished.  Still five lakhs posts are lying vacant in various departments.  Many departments are closed or privatised.  More and more casual and contract workers are engaged.  Social security schemes, including statutory Pension scheme are given a go-bye.  Instead, share market oriented contributory Pension scheme is introduced.  Three lakhs Gramin Dak Sevaks of the Postal department are denied of their legitimate rights.  Casual, Part-time, contingent employees are not given their due wage revision.  Even compassionate appointments are denied imposing arbitrary restrictions.  Bonus ceiling not raised.  Further the Government has declared the National Postal Policy 2012 which is nothing but a road-map to privatisation of Postal Services by granting licences to the multi-national courier services. 
               The demand for appointment of 7th Pay Commission is not yet accepted, inspite of the thundering success of the 12th December 2012 strike organised by Confederation of Central Govt. Employees & Workers.  As an impact of the strike, all the Central Trade Unions have submitted a memorandum to the Finance Minister to announce constitution of 7th CPC in the February 2013 budget itself.  Still the Government is silent on Pay Commission and merger of 50% DA.  February 20, 21 strike is a continuation of 12th December strike.
               The steep rise in prices of essential commodities, disbanding of the public distribution system, deregulation of petrol and diesel prices , disinvestment of public sector, rise in unemployment, shrinking of employment opportunities, proposed move to amend the labour laws in favour of the employers, attack on social security, denial of assured pension for all, introduction of contract and casual labour system in all sectors, denial of minimum wage of Rs.10,000/- to industrial workers, refusal to remove bonus and PF ceilings etc. are all due to this neo-liberal economic policies.
               The attack is all round.  To save the Postal, to save the Central Govt. departments, to save the public sector, to save the common people and workers of our country including Postal employees the only way out is to fight back these policies.  Let us wholeheartedly join this struggle and make it a historic success.

43-01/2013: Speed Post Hub (ICH), Palakkad Distribution of Bags-reg

 Consequent on the introduction of the Intra Circle Hub at Pallakkad, Ottapalam HO is functioning as a transit point for transmission of Speed post bags linked to 20 Sub offices of our Division and HO at 0645 hrs. As the exclusive MMS are starting from Ottapalam Sorting from 0645 hrs itself this arrangement may be reviewed and the bags may be conveyed from Ottapalam Sorting.

02/2013: Filling up of Vacancies at Mannarkkad College and Thottakkara-reg

             One Post of PA is vacant at Mannarkkad College SO consequent on the deputation of one PA to Palakkad ICH. Similarly, the post of PA will become vacant with effect from 1st February -2013 consequent on the voluntary retirement. It is requested to take action to fill up these posts as the absenteeism will adversely affect the functioning of these offices.

            03/ 2013: Despatch of bags to ICH, Palakkad-reg
           
            The provision to dispatch speed post bags to ICH, Palakkad is to be made in the software as provision to dispatch bags to Trissur is only made default in the module. Necessary provision may be made.

            04/2013: Heavy leakage in Staff Quarters, Shornur-reg

There is heavy leakage through roof in Staff Quarter No. II/ 2, though the repair works were completed recently only.  It is also reported that supply drinking water is disrupted in two blocks due to some blocks in the water pipes. The defects may be rectified early.

35-01/2013: Delivery of Aadhar articles--reg.
           
            It is noticed that Aadhar articles are being received at Offices on large scale and its delivery is impossible within normal working hours. As such, in order to minimize the hardship to employees some special arrangement, wherever necessary may be provided.

02/2013: Provision of one additional delivery staff at Tenkara-reg

           The Tenkara area is a vast and swiftly developing one as the area is close to the Mannarkkad Town. Covering entire area to deliver articles in not practical now a day. Hence, creation of one more delivery staff may be considered, urgently.

03/2013: MTS officiating arrangement in Divisional Office-reg
            It is noticed that when officiating arrangement in MTS posts is made with GDS their eligible weekly off wages is not allowed with a plea that the Divisional office has only 5 working days, which is not justifiable. As the GDS officiating as MTS is also working extended hours during working days, the denial of wages of Saturday and Sunday is not correct. This may be regularized immediately.

04/2013: Filling up of Post of GDS SV, Shornur-reg

            This is an item discussed in the earlier meetings. As the staff position of the office is very poor and the existing staff are very much aggrieved, it is requested to take up the filling up of the vacant post once again.

Madam,

            In accordance with the provisions of Sub Section (1) of Section 22 of the Industrial Disputes Act, 1947, we hereby notify that all the Postal/RMS/MMS/Administrative & Postal Accounts Employees and the Gramin Dak Sewaks will go on two days strike on 20th and 21st February 2013. The demands for acceptance of which the employees embark upon two Days Strike are detailed in the Charter of Demands enclosed.

                                          CHARTER OF DEMANDS
PART – I
1. Take Concrete measures to contain price rise.
2. Take Concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs,
3. Ensure Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws,
4. Universal social security cover for the unorganized sector workers without any restriction and creation of a National Social Security Fund with adequate resources in line with the recommendation of NCEUS and Parliamentary Standing Committee on Labour.
5. Stoppage of disinvestment in central and state PSUs.
6. No Contractorisation of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry/ establishment
7. Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/-.
8.   Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.
9.   Assured statutory Pension for all
10.       Ensure Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions nos 87 and 98
PART – II
1.      Appoint Seventh Central Pay Commission for revision of wages of Central Government Employees including Gramin Dak Sewaks. Grant merger of 50% of DA with pay for all purposes, including GDS.
2.      Stop abolition of posts and restore all abolished posts with immediate effect.
3.      Grant Civil Servant status to Gramin Dak Sewaks and extend all benefits of regular employees to GDS also. Enhance GDS Bonus ceiling from 2500/- to 3500/- . End discrimination in wages and other service conditions.
4.      Revise the wages of Casual, Part-time & contingent employees with effect from 1.1.2006 at par with the minimum pay scale implemented as per 6th CPC recommendations. Regularisation of the services of casual labourers.
5.      Drop the proposal for privatization of Postal Sector and retrograde clauses of the National Postal Policy 2012.
6.      Revision of OTA rates as per the Arbitration award.
7.      Complete the cadre restructuring and honour the assurance given to staff side.
8.      Remove arbitrary restrictions imposed on compassionate appointments.

PROTEST AGAINST MANUAL PREPARATION OF PA-17(a)

Sub:- Maintenance of form Pa-17 Part 1 & II (SO Account ) in manual form
Sir,

It is noticed that the Divisional Administration has issued instructions to prepare Pa-17 form (Part 1&2) manually citing a letter No. DDG (Tech).Misc dated 20-11-2012, received from Directorate, vide No. RC1/Rlgs dated 20-12-2012 addressed to all Departmental Offices.

At the out set, this Union wishes to intimate that maintaining Pa-17 is merely unwarranted and irrelevant in the present set up, even in the inspection point of view, for the following reasons:

1)      In the present set up , as all the SOs are completely computerized, any information required will be available in the soft ware, back up  copies, and from the hard copies of reports.
2)      Before computerization, office copy of daily account was not prepared and kept on record and therefore copy of account was necessary to view and inspect the day’s transactions. Now office copy of daily account is being maintained and available on record in the shape of hard copy. The same can be available in the system also. Any inspecting officers can verify accounts easily than previously.
3)      Using the Treasury module there is provision to prepare “Sub Office Monthly Account “ which reflects all transactions of the month and is as good as Pa-17 form.

Hence, considering the above facts, it is requested the Divisional administration not to insist maintaining of Pa-17 Part 1&II manually hereafter, as our all Departmental Sub Offices are fully computerized.

An early action in the matter is solicited.

ORDER
For redressal of the grievance of the applicant, a committee was constituted as early as 27 September 2011 and as such, this  has been got adjourned on several occasions. Today, the counsel for the respondents seeks three months more time as the Committee is to be reconstituted in view of the retirement of one of the members. It is not exactly known to the Tribunal as to the stage up to which the committee has reached. As sufficient time has already expired, it is appropriate that two months and no more time is granted for the Committee to arrive at a decision and communicate the same to the applicant. Reply to the OA shall also be filed immediately after arriving at a decision, so that this can be considered accordingly.

In view of the above, the following directions are issued.
(a)   The Committee shall decide the issue within two months from today.
(b)   Reply shall be filed within a week thereafter on the basis of the decision of the committee.

List this case for further consideration on 12.03.2013.
